Bill Forcing Landlords to Stay in the Rental Housing Business

AB 854 won approval with a 12-3 vote. This bill would prohibit landlords from terminating tenancies and exiting the rental market until they have owned the property for 5 years.

The existing law, knows as the Ellis Act, prohibits public entities from adopting any statute, ordinance, regulation, or taking any administrative action to compel the owner of residential real property to offer or to continue to offer accommodations, as defined, in the property for rent or lease.

This bill would prohibit an owner from filing a notice with a public entity for intent to withdraw accommodations or recovering possession unless they have owned the property for at least 5 continuous years.
